Official Sweepstakes Rules
No purchase is necessary to enter or win. A purchase will not increase an entrant’s chance of winning.
  1. Event
    Win a Vegan Cruise with Holistic Holiday at Sea 2023 (the “Sweepstakes”)

  1. Eligibility
    The Sweepstakes is open to persons who are 18 years of age or older as of the time of entry and who have not previously attended any Holistic Holiday at Sea cruise. Any previous Holistic Holiday at Sea cruise guests are not eligible to enter and cannot be awarded one of the two tickets within the prize package as either the Winner or Travel Companion. Employees of Holistic Holiday at Sea, Inc. (“Sponsor”), JB Media Group, LLC (“Promoter”), and their respective parent companies, affiliates, subsidiaries, retailers, advertising, and promotion agencies (together, the “Sweepstakes Parties”) as well as the immediate family (spouses, parents, children, siblings, and spouses of each) and household members of each such employee are not eligible to enter or be awarded the Sweepstakes prize.

  2. Sponsor
    Holistic Holiday at Sea, Inc., a Florida-based corporation (“Sponsor”).


  1. Period
    The Sweepstakes will begin at 12:00 am Eastern Daylight Time (“EDT”), October 3, 2022 and end at 11:59 pm EDT, November 11, 2022 (“Sweepstakes Period”).


  1. How to Enter
    Entries must be completed online via the Sweepstakes entry form available at https://win.holisticholidayatsea.com/ (“Sweepstakes Entry Form”) during the Sweepstakes Period.


  1. Entry Guidelines
    Entrants must complete all required fields on the Sweepstakes Entry Form for the entry to be valid. Entries are limited to one per person, per email address, and per household. Multiple entries from the same person either using the same email address or different email addresses will be disqualified. Automated entries are prohibited, and any use of such automated devices will cause disqualification of all associated entries. 

    All entries become the property of the Sponsor and will not be returned or acknowledged. By entering the Sweepstakes, entrants agree to receive communications from the Sponsor.

    Sponsor has the sole discretion to determine whether an entry is eligible. Any entry that violates the Official Rules or is otherwise objectionable, as determined solely by Sponsor, will be disqualified. Sponsor does not assume responsibility for third parties’ failure to act in accordance with Sponsor’s instructions pertaining to the implementation of the Sweepstakes.


  1. Privacy
    Entrants understand that all information provided is collected by the Sponsor and is subject to Sponsor’s privacy policy.

  2. Prize Drawing
    One potential winner will be chosen by a random drawing to be conducted by the Sponsor on or about November 11, 2022 from among all eligible entries received during the Sweepstakes Period. Odds of being selected depend on the total number of eligible entries received during the Sweepstakes Period. If the potential winner does not meet the requirements outlined within the Official Rules, the Sponsor will select an alternate potential winner from the remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain unawarded.


  1. Winner Notification
    The potential winner will be notified via email within five (5) days of the drawing. To claim the prize, the potential winner will be required to complete and return a Declaration of Eligibility/Liability (“Declaration”) and Publicity Release (“Release”) by the tenth day after the email notification date. If the potential winner cannot be contacted or fails to return the Declaration and the Release, the potential winner forfeits the prize and an alternate potential winner will be selected in a random drawing. Potential winners must continue to comply with these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, the Sponsor will award the prize to an alternate potential winner by random drawing from the remaining eligible entries.

    Once requirements outlined in these Official Rules are met by the potential winner and for as long as she/he continues to meet such requirements, she/he will be considered the prize winner (“Winner”). Except where prohibited by law, acceptance of the prize constitutes permission for the Sweepstakes Parties to use the Winner’s name, photograph, likeness, voice, or any comments made by or attributed to Winner for promotional purposes in any and all media throughout the world in perpetuity and to incorporate any such information into any audio/visual recording or broadcast for such promotional purposes without additional review by, permission of, or further compensation to the Winner.


  1. Prize
    Accommodations in one Inside Cabin on a Sponsor-operated seven (7) night cruise, including prepaid gratuities, to be shared by the Winner and one travel companion of the Winner’s choosing (“Travel Companion”). The prize package has an approximate retail value (“ARV”) of $4,926. The prize does not include travel to the cruise ship’s port of call, sales and income taxes, service charges, port taxes, fuel surcharges, shore excursions, personal expenditures, or any other expenses not specified herein. All expenses not included in the prize are the responsibility of the Winner.

    If the Winner’s cabin selection is a lesser value than the ARV, the difference in value will be forfeited as a prize. No substitutions will be made for the prize. The value of the prize as set forth above represents Sponsor’s determinations of the ARV in its sole and absolute discretion thereof and such determinations are final and binding and cannot be appealed.


  1. Prize Redemption
    The Sponsor will provide redemption instructions to the Winner by email within five (5) days after Sponsor receives both the completed Declaration and the Release from the Winner. The prize must be fully redeemed (booked) no later than December 1, 2022 or the Winner will forfeit the prize. The Winner and the Travel Companion will be required to complete a Release of Liability prior to travel. If the Travel Companion is a minor, a legal guardian must complete a Release of Liability for the Travel Companion prior to travel.

    The prize is not transferable. The prize may not be combined with any other offer. No refunds or credit for changes are allowed. The Sponsor reserves the right to substitute a prize of equal or greater value in the event the prize is unavailable.

    If required by law, the Winner will receive an IRS Form 1099 on the value of the prize and will be required to provide her/his social security number or equivalent tax ID number on the Declaration.


  2. General Terms
    By entering this Sweepstakes, all entrants agree to be bound by the Official Rules and decisions of the Sponsor, which will be final and binding in all respects. In the event of a dispute as to the identity of an entrant, the prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address. Sponsor reserves the right, at its sole discretion, to permanently disqualify any individual it believes has intentionally violated these Official Rules including tampering or attempts to tamper with the entry process or the operation of the Sweepstakes or website, or acts in a disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

    WARNING: ANY ATTEMPTS BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH, OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY  LAW.

    The Sweepstakes Parties are not responsible for lost, late, or misdirected entries; technical, hardware or software malfunctions; telephone failures of any kind; lost or unavailable network connections; or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in the Sweepstakes which may limit the ability of an individual to participate in or accept the prize in the Sweepstakes, or by any human error which may occur in the processing of the entries in the Sweepstakes. The Sweepstakes Parties are not responsible for any typographical errors in the printing of the Official Rules, administration of the Sweepstakes, or in the announcement of the Sweepstakes prize. The Sweepstakes Parties are not responsible for damages to an entrant’s system brought about by participating in the Sweepstakes or downloading any information to participate in the Sweepstakes. Sponsor reserves the right to modify or cancel the Sweepstakes if it becomes technically corrupted, including a computer virus or system malfunction that inalterably impairs the Sponsor’s ability to conduct the Sweepstakes. In such event, Sponsor would award the prize from among all eligible entries received prior to cancellation.

 

  1. Release and Limitations of Liability

    By participating in the Sweepstakes, entrants agree to release and hold harmless the Sweepstakes Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to:

    (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections; availability, accessibility, miscommunications, or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties;
    (b) unauthorized human intervention in the Sweepstakes;
    (c) mechanical, network, electronic, computer, human, printing or typographical errors;
    (d) application downloads;
    (e) any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the Winner, the cancellation or postponement of the event, if applicable, the processing of entries, or in any Sweepstakes-related materials; or
    (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants’ participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto).

    The Sweepstakes Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant further agrees that in any cause of action, the Sweepstakes Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorney’s fees.

  2. Dispute Resolution
    All dispute resolution shall be made by the Sponsor in its sole discretion. Entrants agree that any and all disputes, claims, and/or action arising out of or connected with the Sweepstakes or the prize shall be resolved individually, without resort to any form of class action. Any and all claims, judgments and/or awards shall be limited to actual out-of-pocket costs associated with entering this Sweepstakes and shall not include any punitive, consequential, or other damages, and in no event shall include attorneys’ fees. Under no circumstances will any entrant be permitted to obtain any award for and entrant hereby waives all rights to claim indirect, special, punitive, incidental or consequential damages of entrant and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

    All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the state of Florida without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Florida. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts sitting in Miami Dade County, Florida, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules.

  3. Legal Compliance
    The Sweepstakes shall be construed and evaluated solely according to the laws of the United States of America and subject to all applicable federal, state and local laws and regulations. It shall be considered void where prohibited. Entrants acknowledge compliance with the Official Rules, including eligibility restrictions.

  4. No Waiver
    The invalidity or unenforceability of any provision of the Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, the Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

    To receive the name of the winner, where permitted by law, send a self-addressed and stamped envelope by December 1, 2022 to JB Media Group, 915 Haywood Rd, Ste 101, Asheville NC 28806.
